These Terms of Use are intended to govern your (hereinafter, the “User”) use of the AEAAS Project Website at https://aeaas.eu/ (the “Website”).

The Alliance for European Autonomous Access to Space (“AEAAS” or “We”) is a project funded by the European Union under the Horizon Europe Framework Programme, managed by the European Health and Digital Executive Agency (HaDEA) of the European Commission.

Acceptance of these Terms of Use is mandatory for any User who accesses, browses, or interacts with the AEAAS Project Website. If you do not agree to these Terms of Use, please refrain from browsing the Website.

Your contractual partners upon entering into these Terms and Conditions are the members of the AEAAS Consortium (hereinafter, the “Consortium” or “We”), as follows:

1. Scope of Application

1.1. These Terms of Use constitute a contract between Users and the Consortium regarding access to, browsing of, and use of the Website.

1.2. Access to our Website is prohibited to minors under the age of 16. By accessing the Website, you confirm that you meet this requirement.

1.3. Access to, and browsing of, the Website is free of charge.

1.5. By accessing and browsing the Website, the User tacitly, unequivocally, and unreservedly accepts these Terms of Use and declares, for all intents and purposes, that they have the legal capacity to enter into contracts and assume all obligations associated with such contracts.

2. Website Owner and Operator

2.1 This website is operated by ASTech Paris Region, Association Loi 1901(“ASTech”), on behalf of the Consortium.

3. EU Funding Acknowledgement and Bindingness

3.1. This project has received funding from the European Union’s Horizon Europe research and innovation programme under Grant Agreement No. 101295883.

3.2. The contents of this website reflect only the views of the Consortium and do not necessarily represent the official position of the European Union or the European Health and Digital Executive Agency (HaDEA). Neither the European Union nor HaDEA can be held responsible for any use that may be made of the information contained herein.

4. FAIR Principles and Open Access

The AEAAS project is committed to the FAIR principles (Findable, Accessible, Interoperable, and Reusable) for the management of research data and outputs. In accordance with the Horizon Europe Open Science requirements, project deliverables, publications, and research data will be made openly available to the extent permitted by applicable legal obligations, confidentiality requirements, and third-party intellectual property rights.

5. User Obligations

5.1. By accessing and browsing the Website, the User agrees to:

a. Not engage in activities that are unlawful or contrary to good faith and public order, or use the Website or its contents for any such purpose.

b. Not to cause damage to the Website’s physical and logical systems, its suppliers, or third parties; nor to introduce or spread a virus into the computer network or any other physical or logical system capable of causing the aforementioned damage.

c. Not violate or attempt to circumvent the Website’s security or authentication measures, or those of any connected network, or the security and protection measures inherent in the content offered on the website.

d. Not take any action that causes disproportionate, unjustified, and unnecessary overload on the Website’s infrastructure or network systems, or on network systems connected to the website; or prevent the normal conduct of an event, contest, promotion, or any other activity available through the website or any of its features, whether by altering or attempting to alter, illegally or otherwise, access, participation, or operation, falsifying the results, and/or using fraudulent methods of participation, by any means, and/or through any practice that in any way violates these Terms of Use.

5.2. We reserve the right to suspend, modify, restrict, or discontinue, temporarily or permanently, access to, browsing of, use of, hosting of, and/or transfer of content and/or use of the Website’s services, regardless of prior notice, with respect to Users who violate any of the provisions of the Terms of Use, without the User being entitled to claim compensation for this.

5.3. Users who fail to comply with the Terms of Use will be held liable in accordance with the general terms.

6. Intellectual Property

6.1 Users acknowledge, unless otherwise indicated, that the content of the Website, including but not limited to text, graphics, logos, images, reports, publications, including Deliverables, is the property of the Consortium or its respective partners and is protected by applicable intellectual property laws.

6.2. You may access, download, and use materials published on this website for personal, non-commercial, and informational purposes, provided that you:

(a) Retain all copyright and proprietary notices;

(b) Acknowledge the source and, where applicable, cite the AEAAS project and EU institutions appropriately;

(c) Do not modify or create derivative works without prior written consent of the Consortium.

6.3. Under no circumstances does the permission to reproduce referred to in the preceding paragraph imply a waiver, license, or transfer—whether total or partial—of these rights, except where expressly stated.

6.4. By submitting information, inquiries, feedback, or other content through the interactive features of this website (including the “Contact Us” section), Users grant to the Consortium and its partners an irrevocable, non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt, publish, and distribute such information for the purposes of the AEAAS project, including but not limited to:

(a) Responding to your inquiry and facilitating stakeholder engagement;

(b) Informing the development of regulatory recommendations, policy briefs, and project deliverables;

(c) Publishing anonymised or aggregated findings in accordance with the FAIR principles and open access commitments of the project and incorporating feedback into Project Results;

(d) Fulfilling reporting obligations to the European Commission and HaDEA.

6.5. This licence does not affect Users’ rights under applicable data protection legislation, including your rights under the General Data Protection Regulation (GDPR) as set out in our Privacy Notice.

7. Disclaimer of Warranties

7.1. The content of this website is provided for general informational purposes only and does not constitute legal, regulatory, or professional advice. While the Consortium endeavours to ensure that the information published is accurate, complete, and up to date, no warranty or representation, express or implied, is made as to the accuracy, reliability, or completeness of any information contained on this website.

7.2. The Consortium, its partners, and their respective officers, employees, and agents shall not be liable for any loss, damage, or expense arising from the use of or reliance on the information provided on this website, to the fullest extent permitted by applicable law.

7.3. These Terms of Use and any disputes arising out of or in connection with the use of this website shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of laws principles. The courts of Lisbon, Portugal, shall have exclusive jurisdiction over any dispute arising from or related to the use of this website.

10. Modifications

The Consortium reserves the right to modify these Terms of Use at any time without prior notice. Any changes will be effective immediately upon posting on this website. Your continued use of the website following any modifications constitutes acceptance of the revised Legal Notice.
